Macarena Gatica (Chile), Tomás Schoeller Paiva (Brasil) and Diego Fernández (Argentina) discuss the status of the data protection regime in their respective countries. The main focus will be to know to what extent data protection laws in those Latin American countries can be comparable to the one in the EU and if they could be considered to offer an adequate level of protection of personal data. The speakers will have around 15 minutes for a presentation. Then there will be questions. The event is hosted by Andrea Lucia Tapia-Hoffmann.

Macarena Gatica (Chile)

Macarena leads the area of Technology, Media, Telecom and Data Protection. She has more than 15 years of legal practice and has extensive experience in the areas of technology, data protection, cybersecurity and e-commerce.

She has worked on projects with companies from various industries: financial (Grupo Security, Bci), securities (DCV), retail (Tricot), food (Agrosuper), education (Aiep), insurance (Vida Security), health (Bupa), automotive (Derco), technology (Masterbase) among others, characterized by providing more than advice an accompaniment in a process of adaptation to new standards and determining regulatory risks with a clear orientation to the client’s business.

She has been invited to legislative committees in the Chilean Congress, specifically during the processing of the bill on personal data.

Tomás Schoeller Paiva (Brasilien)

Partner in the practice areas of Telecommunications, Media and Technology, Infrastructure and Project Finance, and Public and Regulatory Law at Demarest, Tomás Filipe Schoeller Paiva holds a PhD in Constitutional Law from the Université Paris I Panthéon-Sorbonne and the University of São Paulo (USP), a master’s degree in Constitutional Law from the University of Lisbon and a postgraduate degree in Competition Law from the University of Brasília (UNB). He has extensive experience in the field of telecommunications regulation, new technologies, media, and data protection. Tomás is recognized in some of the most prominent international legal publications, such as Chambers & Partners, The Legal 500, Global Data Review and Expert Guides.

Diego Fernández (Argentina)

Diego is a partner in the IP, IT & privacy practice group at Marval O’Farrell Mairal in Argentina. He is a former foreign associate in the IT & Privacy group at Foley & Lardner, Chicago.

Diego is an Executive Committee member of ITechLaw, Co-Chair of the IAPP’s Argentine Chapter (and Advisory Board member), member of the Data Protection Committee of INTA, and member of the Technology Committee of IBA.

Diego is the President of the Privacy & M&A Committee of the Latin America Privacy Association (ALAP) and Editorial Board Member of the Global Privacy Law Review.

Diego is a professor on the Privacy & Data Protection Legal Education Executive Program at Universidad Di Tella. He is also a guest professor at The John Marshall Law School, Chicago (United States) in its online course on Global Privacy.
